Political and social debate over the Foreign Contribution Regulation Act (FCRA) has intensified across the country, with the FCRA Amendment Bill, 2026 being referred by the Lok Sabha to a Joint Parliamentary Committee (JPC) for detailed examination.

Rajnandgaon Lok Sabha MP Santosh Pandey has welcomed the proposed legislation and advised opposition parties that if they have objections to any of its provisions, they should present their views and concerns before the JPC instead of taking their protest to the streets.

Pandey emphasised the need for transparency and monitoring of organisations operating with foreign contributions. He said questions have periodically been raised over the activities of several NGOs in remote tribal areas of Chhattisgarh, including Surguja, Bastar and the Manpur-Mohla tribal region within the Rajnandgaon Lok Sabha constituency.

He questioned the need for an impartial inquiry into such matters, asking whether an organisation whose activities fall under suspicion should not be investigated.

Accountability for Foreign Funds Essential

The fundamental objective of the FCRA is to regulate financial contributions received from abroad in India and ensure accountability in their utilisation.

The law provides for monitoring various aspects of foreign contributions, including which organisation received the funds, the purpose for which they were received, where they were spent and whether their utilisation complied with prescribed rules.

The FCRA Amendment Bill, 2026 proposes provisions concerning the management of assets and funds created through foreign contributions in cases where an organisation’s FCRA registration is cancelled, voluntarily surrendered or otherwise ceases to remain valid.

For this purpose, a mechanism involving a Designated Authority has been proposed.

Government and Opposition Present Different Arguments

The government’s principal argument in support of the Bill is the need to ensure transparency, accountability and compliance with regulations in foreign funding.

The Opposition and some organisations, however, have raised concerns over certain provisions of the proposed legislation, expressing apprehension that it could increase government monitoring and control and affect non-governmental and social organisations.

With the Bill now referred to the JPC, the committee will examine its provisions in detail, hear the views of concerned stakeholders and make its recommendations.

The future form of the legislation is expected to become clearer following the committee’s review and recommendations.

Transparency at the Centre of the Debate

The ongoing FCRA debate needs to be viewed beyond the political confrontation between the ruling side and the Opposition, with the central issue being transparent accounting of funds received from abroad and their utilisation for the prescribed purposes.

According to Santosh Pandey, if an organisation is complying with the rules, a transparent system would only strengthen its credibility. In cases of violations, investigation and action in accordance with the law are necessary.

Attention is now focused on the Joint Parliamentary Committee. Its review and recommendations will determine how the FCRA Amendment Bill, 2026 moves forward and in what form.

The central question remains whether transparent accounting and strict accountability should be ensured for the utilisation of every fund received in India from foreign sources.
