Chhattisgarh High Court Slams Raipur Hospital for Violating Patient Privacy

The Chhattisgarh High Court has strongly criticized Dr. Bhimrao Ambedkar Memorial Hospital, Raipur, for an incident that violated a woman’s right to medical privacy and dignity. The matter came to light when a local newspaper reported that a hospital noticeboard displayed the HIV-positive status of a new mother outside the maternity ward. Taking suo motu cognizance, the High Court called this act “inhuman, unethical, and an assault on human dignity.”

The bench observed that such conduct is a direct violation of Article 21 of the Constitution, which guarantees the right to privacy and personal liberty. The woman, who had recently given birth, reportedly broke down after seeing her name publicly linked with HIV, fearing social stigma and discrimination. The hospital administration initially claimed it was an error by a staff member, but the court refused to accept the excuse.

The court has directed the Chief Secretary of Chhattisgarh to file a personal affidavit by October 15, detailing the measures being taken to ensure patient confidentiality across all government hospitals. The court also ordered sensitivity training for healthcare workers and strict disciplinary action against those responsible for this negligence.

Judges emphasized that health data must be treated with utmost secrecy. They remarked, “The pain and humiliation caused by careless disclosure can last a lifetime.” Medical experts and human rights activists have welcomed the court’s stand, calling it a “necessary reminder” that patient privacy is not optional but a fundamental right. The incident has triggered a state-wide review of hospital procedures to prevent similar lapses in the future.
